1. Introduction and acceptance of terms

1.1 Contracting party

These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you and Pawnfind LLC, a limited liability company incorporated in the State of Delaware, USA (hereinafter “Pawnfind”, “we”, or the “Platform”). By accessing, browsing, or using pawnfind.com, its subdomains, the mobile application, or any related service (collectively, the “Platform”), you (“User”, “Service Provider”, or collectively, the “Parties”) acknowledge that you have read, understood, and accepted these Terms.

1.2 Purpose

Pawnfind offers a technology Platform that enables (i) Users —pet owners or caregivers— to search, compare, and book boarding services offered by (ii) Service Providers. Pawnfind acts solely as an intermediary, facilitating agreements between Users and Providers, without being a party to the boarding contract or a direct service provider.

1.3 Acceptance and validity

By checking “I accept the Terms and Conditions”, creating an account, or using the Platform, you accept these Terms and related policies (Privacy Policy, Cancellation & Refund Policy, and Community Guidelines). If you disagree, you must refrain from using the Platform.

1.4 Modifications

Pawnfind may modify these Terms at any time. Updates will be published with a “Last updated” date, and material changes will be notified at least 15 days in advance by email or within the account.

1.5 Eligibility

  • Be at least 18 years old or the legal age of majority in your jurisdiction.
  • Have full legal capacity to contract.
  • Not have been previously suspended or blocked.

1.6 Language priority

These Terms may be translated. In case of discrepancy, the English version prevails.

1.7 Related documents

These Terms incorporate the Privacy Policy, Cancellation & Refund Policy, Commission & Payment Policy (including 12% commission to the provider and 3% to the user), and Pawnfind Community Guidelines.

2. Definitions

“Pawnfind” or “Platform”: pawnfind.com, subdomains, mobile app, or channels operated by Pawnfind LLC.
“User”: person over 18 who creates an account to book and pay for services.
“Service Provider”: individual or legal entity that lists boarding spaces.
“Pawnfind Account”: profile granting access to the Platform.
“Boarding Service”: accommodation, care, and attention for the pet during the booking.
“Booking”: confirmed request from the User for a boarding service.
“Boarding Contract”: direct agreement between User and Provider; Pawnfind is not a party.
“Boarding Fee”: base price set by the Provider before taxes and commissions.
“Provider Commission”: 12% applied to the Boarding Fee.
“User Service Fee”: 3% applied to the booking subtotal.
“Authorized payment methods”: Stripe, PayPal, credit/debit cards.
“Escrow account”: temporary fund retention until 24h after check-in.
“Check-in / Check-out”: pet drop-off and pick-up time.
“Cancellation policy”: Flexible, Moderate, or Strict, as defined by the Provider.
“User Content”: reviews, photos, descriptions, and messages on the Platform.
“Force majeure”: unforeseeable event such as natural disaster, government order, or illness.
“Applicable laws”: Delaware legislation and mandatory local regulations of the place where the service is provided.

3. User account and registration

Registration is required to use the Platform. You must provide accurate, complete, and up-to-date information. Identity verification and a valid payment method (Stripe/PayPal) may be required. Providers must supply permits, licenses, and establishment details. You are responsible for your account and password. Accounts are personal and non-transferable. Pawnfind may suspend or cancel accounts for violations, fraud, animal mistreatment, false data, or prolonged inactivity.

4. Bookings and payments

The User selects dates and options, accepts the total price, and authorizes the charge. The booking is confirmed when the Provider accepts it or upon expiration of the automatic acceptance period. Funds are held in escrow and include Boarding Fee + 3% user fee + taxes. The net payment to the Provider (less 12% commission) is released 24h after check-in. All transactions are processed in USD.

5. Fees and billing

User service fee: 3% of subtotal, displayed at booking.

Provider commission: 12% of the boarding fee, deducted before payment.

Pawnfind issues receipts for Users and commission invoices for Providers. Taxes and withholdings may apply per local legislation (e.g., VAT in Costa Rica). The Provider must comply with their own tax and invoicing obligations.

6. Cancellations and refunds

Providers must choose a policy: Flexible, Moderate, or Strict. Refunds depend on the timing of the cancellation. Indirect taxes are returned proportionally. If the Provider cancels, a full refund is made to the User and penalties may apply.

Penalties: negligence (unsanitary conditions, false information, unjustified cancellation) may result in sanctions of 12% of the Boarding Fee or USD $25.

7. Obligations and responsibilities

User obligations

  • Provide accurate pet information.
  • Present vaccination records.
  • Disclose aggression or medical conditions.
  • Authorize emergency care.
  • Comply with check-in/check-out times.

Provider obligations

  • Maintain valid licenses and permits.
  • Ensure safe facilities.
  • Have trained staff.
  • Report incidents promptly.
  • Keep calendars and records up to date.

Pawnfind responsibilities

Technology intermediation, document verification, and support in dispute resolution. Liability for damages will be managed per applicable insurance or direct liability of the parties.

8. Insurance and safety

Insurance is recommended but not mandatory. Providers with an active policy (COI) may display a badge on their profile. Without insurance, the Provider assumes the corresponding liability. Claims must be reported with evidence within the timeframes defined by the applicable policy.

9. Prohibited conduct

Strictly prohibited:
  • Animal mistreatment.
  • False information.
  • Payment fraud.
  • Discrimination.
  • Off-platform transactions.
  • Improper price manipulation.
  • Misuse of personal data.
  • System manipulation.
  • Illegal activities.

10. Reviews and feedback

Reviews are only allowed after completed bookings, within the enabled timeframe. Offensive, fraudulent, or irrelevant reviews may be removed. By posting content, you grant Pawnfind a worldwide license for its use within the Platform and its permitted channels under applicable law.

11. Intellectual property

Pawnfind LLC owns the trademarks, copyrights, trade secrets, and other intellectual property assets of the Platform. A limited access license is granted for legitimate use. Unauthorized use, scraping, or brand appropriation is prohibited and may result in legal action.

12. Data protection and privacy

Pawnfind complies with applicable data protection regulations (including Costa Rica Law 8968, GDPR, and CCPA where applicable). We collect identification, contact, pet, payment, and platform usage data.

Purposes: service delivery, fraud prevention, communication, marketing (opt-in), and analytics.

Sharing: payment processors, insurers, authorities, and technology providers.

Retention: 5 years for account/fiscal, 3 years for chats, 12 months for technical logs.

Rights: access, rectification, erasure, objection, and portability. Requests:privacy@pawnfind.com.

13. Indemnification and limitation of liability

Pawnfind offers the Platform “as is”. We do not guarantee uninterrupted continuity or absolute accuracy of third-party content. Users and Providers shall indemnify Pawnfind for breaches, misuse, pet damage, or legal violations.

14. Dispute resolution and arbitration

The Parties will first attempt to resolve conflicts through the Platform's Resolution Center. If unresolved, mediation and/or arbitration may apply under Delaware rules.

Language: English or Spanish.

Law: Delaware.

Class actions: waived; individual claims only.

Deadline: 12 months to file claims.

15. Modifications to terms

Pawnfind may revise these Terms due to legal changes, new features, or market adjustments. Updates will be published with a “Last updated” date, and material changes will be notified 15 days in advance.

16. Applicable law and jurisdiction

Delaware law governs, subject to mandatory local consumer protection and animal welfare regulations where applicable. The English version of these terms is the binding one.

17. Data deletion instructions

In compliance with Facebook platform terms: this section explains how to request deletion of your personal data.

17.1 How to request deletion

  • Option A (email): send to privacy@pawnfind.com with subject “Data Deletion Request”.
  • Option B (account): go to settings and select “Delete account”.
  • Option C (form): visit /contact indicating “Data Deletion”.

17.2 What happens next

  1. Email confirmation within 48 hours.
  2. Deletion from active databases within 30 days.
  3. Temporary retention in backups for up to 90 days, then automatic deletion.
  4. Final confirmation upon completion.
Important: data required to be retained by legal obligation (e.g., tax records) will be anonymized and retained only for the required period.

17.3 Users who log in with Facebook

  1. Go to Facebook Settings > Apps and websites.
  2. Find “Pawnfind” in connected apps.
  3. Click “Remove” to revoke access.
